Terms of Service

These Terms of Service ("Terms") govern your use of the SweatTax mobile application and website ("Service") operated by SweatTax ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering a legally binding agreement to use SweatTax. By using the Service you represent that you meet this requirement.

2. How SweatTax Works

SweatTax is a workout accountability tool. You schedule workouts in the mobile app, receive reminders, and check in to verify attendance via GPS (gym) or timer (home).

Optionally, you may authorize accountability charging on this website (sweattax.com). If you choose to authorize charging:

  • You set a per-miss charge amount (CAD $1–$25) and a miss threshold (1–10 sessions)
  • Your card is automatically charged when you miss sessions after the threshold is reached
  • Charges are determined by our server-side verification system based on check-in data from the app
  • Check-in window: your scheduled start time plus a 15-minute grace period
  • Gym check-in: requires GPS verification within the gym's geofence (75–150m radius) plus 5 minutes of dwell time
  • At-home check-in: requires a minimum 25-minute active timer session

Accountability charging is entirely optional. The app functions without it.

3. Payment Authorization and Automatic Charges

By completing the authorization flow on sweattax.com, you provide explicit consent for SweatTax to charge your payment method as described in Section 2.

  • All payments are in Canadian dollars (CAD)
  • Payment processing is handled by Stripe. Your card details are stored securely by Stripe and never stored on our servers
  • Charges are applied automatically when our server confirms a missed session
  • You will receive an email receipt for each charge
  • Charges are final except where a valid appeal is approved (see Section 4)
  • You are responsible for ensuring your payment method remains valid
  • You may revoke your authorization at any time from your account page at sweattax.com. Revocation takes effect immediately and prevents future charges

4. Appeals

If you believe a miss was recorded in error (e.g., GPS failure, app crash, medical emergency), you may submit an appeal within 24 hours of the missed session by emailing support@sweattax.com with "Appeal" in the subject line. We will err on your side when verification is genuinely ambiguous. Approved appeals result in a full refund of that charge; denied appeals are final.

5. Acceptable Use

You agree not to:

  • Attempt to spoof GPS coordinates or otherwise falsify check-in data
  • Reverse-engineer, decompile, or tamper with the app or website
  • Use the Service for any unlawful purpose
  • Attempt to circumvent the verification or charging system

We reserve the right to suspend or terminate accounts that violate these rules.

6. Account Termination

You may delete your account at any time by contacting us. Upon deletion we will remove your personal data within 30 days, subject to any legal retention obligations. Revoking payment authorization before account deletion is recommended.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we discontinue the service.

7. Disclaimers

SweatTax is provided "as is" without warranties of any kind, express or implied. We do not guarantee that:

  • The Service will be available at all times or free of errors
  • GPS or motion verification will work correctly in all environments
  • Use of the Service will result in any particular fitness outcome

SweatTax is not a fitness trainer, medical provider, or financial advisor. Consult a qualified professional before beginning any exercise program.

8. Limitation of Liability

To the fullest extent permitted by law, SweatTax and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the total amount you have paid in charges over the 3 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or by email. Continued use after changes take effect constitutes your acceptance of the revised Terms.
